The landlord may not impose an early termination charge.
A member terminates by delivering written notice with a copy of the orders. The federal trigger covers a member who signs a lease and then receives permanent change of station orders, or deployment orders of not less than 90 days.
Worked example on timing. Assume rent is due the first of the month and you deliver notice on September 22. The next rent due after that date is October 1, and termination is effective 30 days later, on October 31.
Deliver the same notice on October 2 instead and the clock runs from November 1, making termination effective November 30. A ten day delay costs a full extra month of rent.
What Florida law adds
Florida Statutes section 83.682 defines government quarters to include privatized military housing that is owned, operated, or managed by a private sector company. A member who becomes eligible to live in and opts to move into those quarters may end a civilian lease on written notice effective at least 30 days after the landlord receives it.
That trigger matters if a Mayroad home opens mid lease. The tenant owes rent prorated to the effective date and is not liable for other rent or damages from the early termination. The statute also says its provisions may not be waived or modified by agreement, so a worse clause in a lease does not override it.
- Write the notice and attach the orders, then keep proof of the delivery date, because under the federal clock that date sets everything else.
- Check the calendar against your rent due date before delivering. Notice a few days before the due date rather than just after can save a month.
- Write a forwarding address into that notice at least seven days before leaving early. Florida Statutes section 83.49(5) requires it.
